Acceptance of These Terms
By accessing or using this website, submitting an inquiry, scheduling an appointment, requesting delivery information, or communicating with Rexroad Equipment through the website, you agree to these Terms of Service.
If you do not agree with these terms, do not use the website. Separate written agreements, purchase documents, ownership or title documents, warranty documents, financing documents, delivery forms, inspection records, and return-policy documents may apply to a specific transaction. If those documents conflict with these website terms, the signed transaction documents control.
Website Use
You may use this website only for lawful purposes related to reviewing equipment inventory, requesting information, arranging an appointment, discussing delivery, requesting warranty details, evaluating a trade, or communicating with our team.
You may not:
- Use the website for fraud, misrepresentation, harassment, or unlawful activity.
- Attempt to gain unauthorized access to website systems, forms, accounts, or data.
- Introduce malicious software, automated attacks, scraping tools, or disruptive code.
- Copy, republish, or commercially exploit website content without permission.
- Submit false contact, identity, payment, financing, trade, ownership, serial-number, operating-hour, or equipment information.
Equipment Listings and Availability
Equipment listings are provided for general informational purposes. Inventory, condition, operating hours, attachments, accessories, specifications, colors, pricing, ownership documents, and availability may change without notice.
We make reasonable efforts to present accurate information, but listing errors may occur. Photos, videos, descriptions, and specifications may not show every mark, imperfection, repair, modification, attachment, leak, wear item, or feature. Buyers should review all available documentation, inspect the equipment when possible, and ask questions before purchase.
Equipment remains subject to prior sale until a transaction is confirmed through the required written documents and cleared payment or other agreed consideration.
Pricing, Fees, and Taxes
Unless specifically stated in writing, displayed prices may not include applicable sales or use tax, title or ownership-document fees, registration fees, documentation charges, delivery charges, loading or unloading charges, permit costs, financing costs, insurance costs, or government fees.
Prices and terms may be corrected or changed before a binding purchase agreement is completed. Typographical, technical, or data-entry errors do not obligate Rexroad Equipment to complete a transaction at an incorrect price.
Deposits and Reservations
A deposit or reservation does not create a completed sale unless confirmed in a written agreement. The deposit amount, refundability, expiration date, equipment hold period, and cancellation terms must be stated in the applicable written receipt or agreement.
Failure to complete payment, provide required documentation, arrange delivery, or meet an agreed deadline may result in cancellation of the reservation subject to the written deposit terms.
Purchases and Payment
An equipment purchase is not final until all required documents are signed, identity and payment are verified, and funds have cleared through an accepted payment method.
We may refuse, pause, or cancel a transaction when reasonably necessary to verify identity, ownership, liens, title status where applicable, payment, financing, fraud risk, legal eligibility, export restrictions, or transaction details.
Financing
Financing is subject to lender approval, credit review, income or business verification, identity verification, equipment eligibility, applicable law, and the lender’s terms. Submission of a financing inquiry does not guarantee approval, rate, payment, term, or availability.
Third-party lenders control their own decisions, documents, privacy practices, fees, rates, and requirements. Any financing agreement is governed by the lender’s signed documents.
Trades
Trade values are estimates until the equipment, serial number, ownership documents, operating hours, condition, attachments, service history, payoff, liens, and other relevant information are verified.
We may revise or withdraw a trade offer when the equipment differs from the information provided, has undisclosed damage, inaccurate operating hours, ownership or lien issues, missing attachments, mechanical concerns, or cannot be accepted for legal or business reasons.
Titles, Ownership Documents, and Registration
The buyer is responsible for providing accurate identification, address, insurance, tax, registration, and ownership information when required. Title, registration, tax, agricultural-use, commercial-use, and documentation requirements may vary by jurisdiction and equipment type.
Ownership transfers only as provided in the applicable signed purchase, bill-of-sale, title, certificate-of-origin, lien-release, or other ownership documents. Processing timelines may depend on government agencies, lenders, lienholders, carriers, manufacturers, and third-party documentation services.
Nationwide Equipment Delivery
Delivery availability, pricing, timing, route, carrier, and transport method depend on the equipment, destination, dimensions, weight, loading requirements, permits, route restrictions, weather, carrier availability, and scheduling.
Estimated delivery dates are not guaranteed unless expressly stated in a signed agreement. Delays caused by carriers, weather, road conditions, permits, equipment issues, government action, or circumstances outside our reasonable control do not automatically create a right to damages.
Additional information is available on our Nationwide Delivery page and in any signed delivery documents.
Delivery Inspection and Acceptance
The buyer should inspect the equipment promptly at delivery and document visible transport damage, missing attachments, operating-hour differences, or material condition differences before or at the time of acceptance.
Delivery acceptance forms, photographs, videos, carrier documents, operating-hour readings, inspection reports, and written communications may be used to document equipment condition and delivery status.
21-Day / 55-Hour Return Policy
Qualifying equipment purchases may include a twenty-one (21) calendar day / fifty-five (55) additional operating hour return policy, whichever limit is reached first, subject to the conditions, exclusions, notice requirements, inspection process, and other terms stated on our Return Policy page and in the signed purchase or return documents.
For qualifying returns, return transport is arranged and paid by the seller as provided in the written policy. Equipment with new damage, excessive operating hours, modifications, missing attachments, misuse, neglect, abnormal wear, or other excluded conditions may not qualify.
The signed return-policy documents control all eligibility, transport, inspection, refund, deduction, and timing requirements.
3-Month / 150-Hour Limited Warranty
Qualifying equipment may include a limited warranty covering substantial mechanical failure of qualifying major engine or drivetrain components for three (3) calendar months from delivery or one hundred fifty (150) additional operating hours, whichever occurs first.
The limited warranty does not cover normal wear, routine maintenance, cosmetic issues, electrical accessories, hydraulic hoses, seals, filters, belts, fluids, batteries, consumables, misuse, negligence, improper operation, lack of maintenance, or unauthorized modifications.
At Seller’s discretion, the remedy may include repair, replacement of defective components, or reimbursement of reasonable approved repair costs. The warranty is non-transferable, does not extend beyond the stated limits, and all equipment is otherwise sold AS IS. The written warranty controls all warranty rights and obligations. More information is available on our Warranty page.
New Equipment and Factory Warranties
New equipment may include a manufacturer factory warranty. Coverage, duration, operating-hour limits, exclusions, claim procedures, authorized-repair requirements, parts, and labor are controlled solely by the manufacturer’s warranty documents.
Manufacturer names and typical warranty descriptions shown on this website are informational only. Exact factory coverage must be confirmed for the specific unit.
Extended Warranty or Service Contracts
Extended warranty or service-contract options may be available for certain new and qualifying pre-owned equipment at additional cost. Eligibility, covered components, term, operating-hour limits, deductibles, exclusions, transferability, and claim procedures vary by provider and plan.
No extended coverage is effective unless included in a signed agreement and accepted by the applicable provider.
Inspections, Demonstrations, and Appointments
Equipment inspections, demonstrations, and appointments may require valid identification, proof of insurance, signed forms, safety equipment, qualified operation, and compliance with staff instructions.
We may decline or end an inspection, demonstration, or appointment for safety, weather, operator-experience, conduct, scheduling, site-condition, or inventory reasons.
Equipment Operation and Safety
Farm and heavy equipment can be dangerous. Buyers and operators are responsible for reviewing manuals, warnings, safety labels, load limits, maintenance requirements, attachment compatibility, and manufacturer instructions before operation.
Only properly trained and legally authorized individuals should operate the equipment. Rexroad Equipment is not responsible for unsafe operation, improper attachment use, overloading, unauthorized modification, or failure to follow manufacturer safety requirements.
Customer Communications
By providing your telephone number or email address, you authorize us to respond regarding your inquiry, appointment, equipment, trade, financing request, delivery, transaction, return policy, warranty, or related service.
Message and data rates may apply to text messages. You may request that non-essential marketing communications stop, but necessary transaction and service communications may continue.
Third-Party Websites and Services
The website may link to lenders, carriers, manufacturers, maps, reviews, social media, payment providers, warranty administrators, and other third-party services. We do not control and are not responsible for third-party content, availability, security, privacy practices, or terms.
Your use of a third-party service is governed by that provider’s own agreements and policies.

John Deere, Kubota, Case IH, Caterpillar, Bobcat, New Holland, and other manufacturer names, trademarks, and logos belong to their respective owners. Their appearance on this website does not imply manufacturer ownership, sponsorship, authorization, or endorsement unless specifically stated.
Disclaimer of Website Warranties
The website and its content are provided on an “as available” basis. To the extent permitted by law, we do not guarantee that the website will always be uninterrupted, error-free, secure, current, or complete.

Limitation of Liability
To the extent permitted by law, Rexroad Equipment will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from website use, inability to use the website, reliance on website content, equipment operation, or third-party services.
Nothing in these terms limits rights or remedies that cannot legally be limited or waived.
Indemnification
You agree to be responsible for losses, claims, or expenses resulting from your unlawful use of the website, violation of these terms, submission of false information, infringement of another party’s rights, misuse of website systems, or unauthorized use of equipment obtained through information submitted on this website.
Governing Law
These website terms are governed by the laws of the State of West Virginia, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any dispute relating solely to website use will be brought in a court with proper jurisdiction in West Virginia unless a separate signed agreement provides a different lawful process or location.
Changes to These Terms
We may update these Terms of Service when our website, inventory, services, policies, or legal obligations change. Updated terms become effective when posted unless a different effective date is stated.
